Guide
How employment claims work in Los Angeles
Deadline to file with the CRD
Discrimination, harassment and retaliation claims under California’s Fair Employment and Housing Act generally must be filed with the Civil Rights Department within three years of the last unlawful act. The window was extended from one year by AB 9 in 2020.
Time to sue after a right-to-sue notice
Once the CRD issues a right-to-sue notice, you generally have one year to file a lawsuit in Superior Court. Workers can request an immediate right-to-sue notice instead of a CRD investigation.
City of Los Angeles minimum wage
The citywide minimum wage rose from $17.87 to $18.42 an hour on July 1, 2026. The California statewide minimum is $16.90, and the higher local rate applies to work done inside city limits.
At-will does not mean anything goes
California employers can usually end employment at will, but not for an illegal reason such as discrimination, retaliation for a complaint, whistleblowing, taking protected leave or in breach of a contract.
Wage claims can go to the Labor Commissioner
Unpaid wage claims can be filed with the California Labor Commissioner, which has a Los Angeles office downtown. Retaliation complaints to the Labor Commissioner generally have a one-year deadline.
Federal claims run on a shorter clock
Federal discrimination claims can also be filed with the EEOC. After an EEOC right-to-sue letter, a federal lawsuit generally must be filed within 90 days.

FAQ
Frequently asked questions
How long do I have to file a discrimination or harassment claim in California?
Under the Fair Employment and Housing Act, you generally have three years from the last discriminatory or harassing act to file a complaint with the California Civil Rights Department. After the department issues a right-to-sue notice, you generally have one year to file a lawsuit. Other claims, such as wage claims, have their own deadlines, so check with a lawyer early.
Do I have to go to the Civil Rights Department before I sue my employer?
For claims under the Fair Employment and Housing Act, yes. You must first file with the Civil Rights Department and get a right-to-sue notice. You can ask for an immediate right-to-sue notice if you plan to file in court with a lawyer rather than have the department investigate.
What is the minimum wage in the City of Los Angeles?
Since July 1, 2026, the City of Los Angeles minimum wage is $18.42 an hour, up from $17.87. The statewide California minimum wage is $16.90. Some industries, such as large hotels and certain healthcare employers, have higher rates.
How do employment lawyers in Los Angeles charge?
Many lawyers who represent employees work on a contingency basis, meaning they are paid a share of any recovery. Shegerian-Conniff LLP publishes a no-fees-unless-we-win policy. Broslavsky & Weinman, LLP and McNicholas & McNicholas, LLP both offer free consultations; ask either firm about its fee terms on the first call.
Can I file a wage claim without a lawyer?
Yes. You can file a wage claim with the California Labor Commissioner, which has a Los Angeles office at 320 W 4th St. A lawyer can still help if the claim is large, involves many coworkers, or is tied to retaliation or wrongful termination.
Can I be fired for complaining about harassment or unpaid wages?
No. California law prohibits retaliation against employees who report harassment, discrimination, wage violations or illegal conduct. If you were demoted, cut back or fired after making a complaint, that may be a separate retaliation claim.

Tips for an LA employment case
- Write it down now. Dates, names and what was said fade fast; a simple timeline helps any lawyer evaluate your case.
- Keep copies, not originals. Save your own pay stubs and messages, but do not take confidential company files.
- Watch the clock. CRD, EEOC and Labor Commissioner deadlines differ, and missing one can end a claim.
- Read before you sign. Severance agreements often include a release of claims; have it reviewed first.
- Ask about fees up front. Confirm whether the firm works on contingency and who pays case costs.
- Talk to more than one firm. Fit, communication and case focus matter as much as ratings.
