Guide

How family law works in San Diego

6 + 3

Residency to file

One spouse must have lived in California for 6 months and in San Diego County for 3 months before filing for divorce (Family Code 2320). Legal separation has no waiting requirement and can be converted later.

6 mo

Mandatory waiting period

A divorce cannot become final until at least 6 months and one day after the other spouse is served or appears in the case (Family Code 2339). Temporary custody and support orders can be made during that time.

50/50

Community property

California treats most property and debt acquired during the marriage as community property, which is generally divided equally. Separate property, such as pre-marriage assets or gifts, usually stays with its owner.

30 days

Time to respond

A spouse served with a divorce petition generally has 30 days to file a response. Missing it can let the case proceed by default.

CFLS

Specialist certification

A Certified Family Law Specialist has been certified by the State Bar of California’s Board of Legal Specialization after meeting experience, exam and continuing education requirements.

Best

Custody standard

Courts decide custody and visitation based on the child’s best interests, looking at health, safety, welfare and the child’s continuing relationship with both parents.

FAQ

Frequently asked questions

How much does a family law attorney cost in San Diego?

Most San Diego family law firms bill hourly against a retainer, and total cost depends heavily on how contested the case is. JWB Family Law and Family Law San Diego both offer free initial consultations; ask any firm for its hourly rate and retainer before signing.

What is a Certified Family Law Specialist?

A CFLS is an attorney certified by the State Bar of California’s Board of Legal Specialization in family law. All three firms here have CFLS attorneys: JWB Family Law and Hargreaves & Taylor each have two CFLS partners, and Family Law San Diego lists one on its team.

How long does a divorce take in San Diego?

No divorce in California can be final sooner than 6 months and one day after the other spouse is served. Uncontested cases often finish close to that point, while contested custody or property disputes can take a year or more.

Do I have to go to court for a divorce in San Diego?

Not always. Many cases settle through negotiation or mediation, and some firms offer collaborative divorce. If a judge is needed, San Diego Superior Court hears family cases at several locations across the county.

Are there discounts for military families?

Two of the three firms publish one. JWB Family Law offers 15% off to military members and spouses, and Family Law San Diego offers 10% to active-duty members and 5% to veterans and spouses. Hargreaves & Taylor handles military divorce but does not publish military pricing, so call to ask.

Can I get an emergency custody order in San Diego?

California courts can issue emergency (ex parte) custody orders when a child faces immediate harm or risk of removal from the state. JWB Family Law lists emergency custody orders as a practice area.

Tips for a San Diego family law case

  • Disclose everything early. California requires full financial disclosure, and missing documents stall settlements.
  • Keep a parenting log. Dates, exchanges and missed visits carry weight in custody disputes.
  • Ask who handles your case. Find out which attorney will appear at hearings, not just who runs the consultation.
  • Get the fee terms in writing. Confirm the hourly rate, retainer and how often you will be billed.
  • Use the court self-help center. San Diego Superior Court offers free help with forms if you are filing on your own.
